Key Relationship
PaintersInToronto.ca is a referral and lead-generation website. It collects painting and coating inquiries and may connect suitable requests with one licensed and insured independent Ontario painting company. The customer contracts with and pays the independent contractor directly for physical painting or coating services.
1. Acceptance of These Terms
These Terms & Conditions govern your use of PaintersInToronto.ca and your submission of quote requests through the website. By using the website or submitting a request, you agree to these Terms, the Privacy Policy and the Service Disclaimer. If you do not agree, do not submit information through the website.
Nothing in these Terms removes or limits consumer rights or other rights that cannot lawfully be waived under applicable Ontario or Canadian law.
2. Purpose of the Website
PaintersInToronto.ca is a painting referral and lead-generation property. The website helps collect inquiries for residential, commercial and industrial painting, interior and exterior painting, cabinet refinishing, spray painting, epoxy flooring, specialty coatings, condo painting, popcorn ceiling removal, drywall and plaster repair within painting scope and related coating projects.
Suitable requests may be reviewed and forwarded to the one independent painting company that the website works with. Submission of a request does not guarantee acceptance, availability, a quote or a particular project outcome.
3. Independent Contractor Relationship
The independent painting contractor is a separate business. The contractor is not an employee, agent, franchisee, legal representative or controlled worker of PaintersInToronto.ca. PaintersInToronto.ca does not supervise or direct the contractor's day-to-day work.
The contractor is responsible for its own site assessment, estimates, quotes, final scope, preparation, materials, product selection, pricing, deposits, payments, scheduling, labour, subcontractors if any, property protection, application methods, cleanup, warranties if offered, change orders, delays, defects, touch-ups, damage claims, disputes and final service outcome.
4. Quotes, Contracts and Project Terms
The website can facilitate a quote request, but it does not replace the contractor's written project agreement. The final estimate or quote, scope of work, exclusions, contract price, deposit, payment schedule, change orders, warranty terms, work dates and other project conditions are between the customer and the independent contractor.
PaintersInToronto.ca is not automatically a party to the painting contract because the request originated through this website.
5. Customer Payments
PaintersInToronto.ca does not collect customer deposits or contractor-service payments through the quote form or as the contracting party for painting work. Payments for the painting or coating project are made directly to the independent contractor according to the contractor's written agreement.
Invoices, refunds, additional charges, payment disputes and chargebacks relating to physical contractor services must be addressed with the contractor, subject to any rights the customer may have under applicable law.
6. Referral Relationship
PaintersInToronto.ca operates as a lead-generation and referral property. The website does not add a separate customer referral fee through the quote form or collect the contractor's project payments. The independent contractor is responsible for setting and explaining the customer's project price, payment terms and any changes to that price.
7. Ontario Consumer Rights
Residential painting and renovation agreements may be subject to Ontario consumer-protection rules depending on the circumstances. The contractor's project agreement remains subject to applicable legal requirements, and customers retain any rights and remedies that apply to them.
These website Terms do not replace the contractor's contract and do not attempt to waive mandatory consumer rights. Ontario publishes current information about written renovation contracts, estimates, change orders and cooling-off rights in certain circumstances at Ontario.ca.
8. Website Information Is General
Website content is general information and may not apply to every property, surface, product, coating system, building or site condition. Cost ranges are estimates or ballpark planning information only and can be lower or higher for the real project.
Users should rely on the contractor's project-specific written quote, manufacturer instructions and appropriate professional advice for the actual work.
9. No Automatic Guarantee or Endorsement
PaintersInToronto.ca works exclusively with one independent licensed and insured Ontario painting company, but this website does not create a separate guarantee of workmanship, pricing, availability, schedule, warranty coverage or project outcome. Any contractor warranty must be confirmed directly in the contractor's written terms.
Nothing on the website should be interpreted as a promise that every service is available in every Ontario community or that every quote request will be accepted.
10. Acceptable Use
You may not use the website to:
- submit false, misleading or fraudulent quote requests
- submit abusive, threatening, defamatory, unlawful or harassing content
- upload malware, malicious code or unlawful files
- attempt to gain unauthorized access to the website, hosting, forms or administrative systems
- interfere with website security, performance or availability
- scrape, copy or republish substantial website content without authorization or another lawful basis
- impersonate another person or misrepresent your authority to request work for a property
11. Intellectual Property
Original PaintersInToronto.ca copy, branding, graphics, layouts, photography, project imagery, Guides and other original website material are protected by applicable intellectual-property laws. Permission may be required before substantial copying, republication or commercial reuse.
Third-party trademarks, manufacturer names, product names, government material and properly licensed third-party assets remain the property of their respective owners. Their appearance on the website does not transfer ownership to PaintersInToronto.ca.
12. External Links
The website may link to government agencies, manufacturers, contractors and other third-party resources. A link is provided for information or convenience and does not automatically create endorsement, partnership or responsibility for the third party's content, security, products or practices.
13. Privacy
The Privacy Policy explains how personal information may be collected, used, shared, retained and protected. Quote-request information may be shared with the independent painting contractor so the request can be reviewed and the customer can be contacted directly.
14. Limits That Applicable Law Allows
To the extent permitted by applicable law, PaintersInToronto.ca is responsible for operating the website and referral process, not for obligations that belong to the independent contractor under the contractor's separate project agreement. This includes the contractor's physical work, pricing, scheduling, payment administration, warranties, workmanship and project-specific decisions.
This section does not exclude liability or consumer rights that cannot legally be excluded or limited.
15. Governing Law
These website Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, subject to any mandatory rights, jurisdiction rules or remedies that apply to the user and cannot lawfully be waived.
16. Changes to These Terms
These Terms may be updated as the website, referral model, services or legal requirements change. The current version will be posted on this page with the revision date. Material changes to privacy practices will also be addressed under the Privacy Policy where required.
